California Ignition Interlock Bill AB 91 Clears Senate Public Safety Committee

A groundbreaking California bill that would create a pilot program requiring first-time DUI offenders in four counties to install ignition interlocks has cleared the Senate Public Safety Committee.

AB 91 would create a program requiring first-time drunk drivers in Los Angeles, Sacramento, Alameda and Tulare counties to install and use ignition interlocks. Multiple-offense DUI offenders would be required to use ignition interlock devices for longer periods.

The California Assembly has already passed AB 91, and its approval by the Senate Public Safety Committee is notable because a similar bill was vetoed by Gov. Arnold Schwarzenegger after being heavily amended by the committee last year.

The passage of AB 91 will be an important step toward making California’s roadways safer for everyone. Ignition interlock devices effectively separate drinking from driving by preventing DUI offenders’ vehicles from starting if they cannot provide acceptable breath samples.

Smart Start’s Ignition Interlocks are More Accurate Because of Fuel Cell Sensors

Smart Start of California’s ignition interlock devices employ fuel cell sensors, which are far superior to the T-cell sensors found in many ignition interlocks. Although ignition interlock devices equipped with fuel cell sensors are more expensive, they provide more accurate readings and require less maintenance and repair.

There are two drawbacks too T-cell ignition interlock devices. The first is that they require frequent calibration, which means they must be serviced often in order to remain accurate.

The second disadvantage to T-cell ignition interlock technology is that the sensors are not alcohol-specific.  The unit can record a “fail” because of cigarette smoke, acidic food such as pizza or Mexican food, acidic fruits such as oranges, gasoline fumes, hair spray, perfumes, cologne, or anything containing alcohol, including mouth wash, cough syrup, or breath sprays.  Because of this, users of ignition interlock devices are always cautioned to rinse their mouths out with water before blowing into the collection tube.

The main advantage to ignition interlock devices equipped with fuel cell sensors is that they are alcohol-specific, meaning that substances such as cigarette smoke or spicy food won’t register a false positive and “fail” the device.  Only substances containing alcohol will trigger the device.

California Ignition Interlock Bill One Step Closer to Passage

AB 91, the proposed California law that would create a pilot program in four counties requiring all DUI drivers to use an ignition interlock device, is one step closer to passage.

AB 91, which would take effect in Los Angeles, San Diego, Alameda and Sacramento counties, has cleared the Assembly Public Safety Committee and will now be considered by the Assembly Transportation Committee. It will then go to the Assembly floor, to the California Senate, and finally to Gov. Arnold Schwarzenegger.

Passage of AB 91, which was authored by Assemblyman Mike Feuer, would make California’s roads safer for everyone. Ignition interlock devices, which prevent cars from starting when drivers are unable to provide acceptable breath samples, effectively separate drinking from driving.  Perhaps most importantly, ignition interlock devices don’t cost taxpayers a dime - DUI offenders pay the cost of installing and maintaining IIDs.

New Mexico was the first state in the nation to require mandatory ignition interlock device use by first-time drunk drivers. At least 45 U.S. states now require some convicted drunk drivers use ignition interlock devices.

California Assembly Holds Hearing on Ignition Interlock Bill

The California Assembly Public Safety Committee will hold a hearing today on AB 91, a proposed bill that would create a pilot program requiring all convicted DUI drivers in four counties to install and use an ignition interlock device.

If passed, AB 91 will require all drivers convicted of DUI in Los Angeles, San Diego, Sacramento and Alameda counties between July 1, 2010 and July 1, 2015 to use an ignition interlock device. Those four counties account for 40 percent of all DUI arrests in California.

Ignition interlock devices prevent a vehicle from starting if the driver is unable to provide an alcohol-free breath sample. The device also requires the driver to perform periodic “rolling retests” to ensure that he or she remains alcohol-free.

Obama Taps MADD Official to Head NHTSA

President Barack Obama has nominated an official from Mothers Against Drunk Driving to head the National Highway Traffic Safety Administration.

Chuck Hurley, who has served as MADD’s CEO since 2005, is an outspoken proponent of requring DUI drivers to use ignition interlock devices.
